Infringement Notices and Fines

The PTO's jurisdiction does not extend to Government policies and legislation, including the issuing and review of infringement notices or fines.

We can investigate the actions and behaviour of Authorised Officers in reporting you for an alleged offence, but this will have no impact on the validity of your infringement notice.

Outlined below is a summary of the infringement process and how you can seek a review.

How infringement notices are issued

When an Authorised Officer issues a Report of Non Compliance (where the Authorised Officer believes an offence has been committed), the Report is forwarded to the Department of Transport (DoT). The DoT then decides whether to issue an infringement notice.

Options on receiving an infringement notice

Infringement notices and public transport fines are issued under the Infringements Act 2006 (Vic). Generally, you have 28 days to take action in relation to the notice/fine. You can:

  • Pay the notice/fine in full
  • Ask the DoT to review the notice/fine (on certain specified grounds)
  • Ask the DoT for a payment extension, if you need more time to pay
  • Choose to dispute the notice/fine in the Magistrates' Court.

Please note, if you choose to do nothing and the 28 days for actioning the notice/fine elapses, you may incur additional costs.

If you choose to ask for a review of the notice/fine, or to take it to the Magistrates' Court we recommend you seek legal advice from your local community legal service, Victoria Legal Aid or a private lawyer.

Options following a review by DoT

If following its review, the DoT does not withdraw or cancel the TIN/fine, you can:

  • Pay the TIN/fine in full by the new due date
  • Ask for a payment extension
  • Choose to go to the Magistrates' Court.
